23951    ◆         OECD 무역과 환경 전문가회의(JWPTE) 권고         ◆         1991년 6월 구성된 OECD 무역과 환경 전문가회의(Joint Working Party on Trade and Environment)는 무역위원회와 환경위원회의 공동 주관으로 매년 약 두 차례의 정례회합을 통해 무역과 환경 연계문제에 대한 구체적 논의를 진전시켜왔다.         이들 작업결과를 바탕으로 1993년 무역과 환경정책을 조화시키기 위한 절차적 지침(Procedural Guidelines)이 개발되었고, 동 절차지침은 각국의 무역정책과 환경정책의 입안자들로 하여금 양 정책이 여타 정책이 미치는 영향을 검토하고 그 결과에 따라 필요한 조치를 취할 것을 권고함으로써 무역과 환경 연계문제에 대한 구체적 해결책을 제시하였다.         무역과 환경 전문가회의는 또한 무역자유화가 환경에 미치는 영향에 대한 1995년 보고서를 통해 적절한 환경정책이 수반되는 경우 무역자유화는 환경에 긍정적인 영향을 미친다는 결론을 도출하였다. 이들은 또한 무역자유화가 환경적 파급효과는 실제로 개별 국가의 특수한 사정에 따라 다를 수 있다는 점을 인정하면서, OECD 회원국들로 하여금 환경정책과 무역정책의 상호 통합 및 양립성을 향상시키기 위한 노력을 계속할 것을 권고하였다.         이와 함께, 환경정책이 국가경쟁력에 미칠 수 있는 부정적 효과를 상쇄하기 위해 WTO 규정에 반하는 보호주의적인 무역조치를 취하거나 수출확대를 위해 자국의 환경 및 보건기준 등을 낮춰서는 안된다는 개별 국가차원의 환경정책 한계를 분명히 밝힌바 있다.         이외에도 환경친화적인 생산공정을 촉진할 목적으로 제품의 생산공정 및 생산방법에 기초한 무역규제가 이루어질 가능성이 있음을 언급하고, 제품의 성격과 관련이 없는 생산공정에 근거한 무역규제 조치가 허용되어서는 안된다는 견해를 표명하였으나, 국경을 넘는 오염의 확산이나 지구환경에 위협을 주는 오염문제와 관련된 환경규제는 국제적 합의를 통해 이루어질 수 있다는 유연성을 보여주었다.         또한 환경보호가 배출된 오염을 제거하는 형태의 사후처리 개념으로부터 제품의 개발단계부터 오염유발 가능성을 줄이고자하는 사전예방 차원으로 발전해 가면서 제품의 전과정에 입각한 환경성 평가(Life Cycle Assessment)개념이 도입되고 있는 점에 주목하여, 전과정평가기법이 현재 개발초기 단계에 있으므로 이에 근거한 환경규제는 아직 시기상조라는 의견을 개진하고, 전과정평가 과정의 투명성 제고, 국제적 기준의 정립, 개별국 인증제도의 상호인정 등 전과정평가제도의 정립에 우선적인 관심이 주어질 것을 촉구하였다.         회원각국에서 환경친화적 조세체계의 확립을 위하여 다양한 환경세제의 도입을 검토하고 있는 현실에 대해서는, 환경세제를 도입한 국가의 산업체들이 추가적인 세부담으로 인하여 국제경쟁력을 상실하는 불이익을 당하지 않도록 현행 WTO체제 내에서 환경세의 국경조정을 허용하는 규정이 있음을 상기하였으며, 이 경우 최종제품에 부과되는 환경세 뿐만 아니라 최종제품의 생산에 투입된 요소에 부과되는 환경세에 대해서도 국경조정을 할 수 있다는 해석이 가능함을 밝혔다.         이상에서 보듯이 OECD 무역과 환경 전문가회의의 작업은 제품의 생산공정 및 생산방법(PPMs)에 근거한 환경규제, 제품의 생산으로부터 소비에 이르는 제품전과정(Life cycle)에 대한 환경성 평가, 환경보호목적의 조세에 대한 국경조정 등 환경측면의 전문적이고 기술적인 주제들에 대한 분석적 연구를 중심으로 진행되어 오고 있어, 자유무역의 원칙을 우선하는 입장에서 환경정책의 무역파급효과를 중점논의하고 있는 WTO 무역환경위원회(CTE)의 활동과는 좋은 대조를 이루고 있다.
